GLASS BOTTOM BOAT TERMS AND CONDITIONS

PLEASE READ CAREFULLY

Both the Operator and any Agent (including their respective employees, agents, officers and directors) exclude, to the fullest extent possible under law, all and any liability for any loss, damage or injury (whether direct or indirect or consequential, however arising) suffered by the Guest or any person associated with the Guest in relation to the booked activity.

All activities have elements of risk and all guests undertaking any Activity do so voluntarily and at their own risk. To the extent permitted by applicable laws, all warranties, representations and implied terms are also excluded.

The Operator reserves all rights to cancel any Activity at its discretion for (but not limited to) any of the following reasons: a) waterway, road or weather conditions; b) lack of numbers participating in the Activity; c) unsuitability of Guest(s) due to reasons such as age, ill health, poor fitness, intoxication or any other reasons rendering a Guest unsuitable or unfit to participate in the Activity; d) any other circumstances which are beyond the reasonable control of the Operator.

All Guests agree to adhere to any instructions in relation to the Activity from the Operator at all times.

The operator is not obliged to refund or provide remedy for missed tours due to late arrival. Although all endeavours will be made to fit you in on the next available activity on the day, there is no guarantee that this will be possible.

These terms are subject to rights and remedies you have under the Consumer Guarantees Act 2003.

Glass Bottom Boat strictly protects the security of your personal information and honours your choices for its intended use.

INTELLECTUAL PROPERTY; LIMITED USE OF THIS WEB SITE.

Glass Bottom Boat makes this web, including all information, files, text, graphics, software, and products available for your use subject to the terms and conditions set forth in this document and any changes to this document that Glass Bottom Boat may publish from time to time (collectively, the “Terms of Use”).

Copyright, trademark, patent, and/or other intellectual property laws protect the Materials in this web, as well as their selection and arrangement.

SNORKEL & KAYAK HIRE

PLEASE READ CAREFULLY

To hire any product offered by Glass Bottom Boat Ltd constitutes a contractual arrangement between you (the customer) and Glass Bottom Boat Ltd.

This represents your acceptance of the Terms and Conditions set out herein. Please ensure that you read carefully and understand these Terms and Conditions prior to hire.

Payment needs to be made when we have confirmed availability in one of the following ways:

By paying online through our booking facility (you will receive a receipt by email)

By visiting the Glass Bottom Boat Ltd team on the beach and making a payment via cash, EFTPOS or credit card.

All equipment must be returned in its present condition or you will be required to reimburse GBB at retail replacement cost (Mask $40, Snorkel $30, Fins $50, Wetsuit $120).

All hired gear must be returned by the stated time, or by 5 pm if an ‘all day hire’.

No refunds are given for unused gear.

You must understand all instructions given to you, including boundaries, and be confident in your swimming/snorkeling ability.

You must not sit on the rocks in the hired wetsuit.

You must respect and observe all Marine Reserve regulations.

A Drivers Licence, Credit Card, or Photo ID must be left for security and will be returned upon return of the hired equipment.

You agree to the charges being the cost of items and authorise GBB to deduct from the stored credit card the funds required to repair or replace an item you damage or lose.
